1. Vyan Airways Services is a consultancy platform specializing in providing placement services for the Aviation sector. However, it does not offer job guarantees or job orientation to candidates. Rest assured, there are no charges for the same services provided by Vyan Airways Services.
2. Any concern raised by the parents or somebody at the branch / centre or customer care did not inform/guide about the terms & conditions properly, shall not be entertained by us. It is also an equal responsibility of the parents / guardians of the candidates to read the terms & conditions thoroughly to enable them to take independent consultancy service decision before making any acceptance of the same service. This kind of complaint or representation shall not be entertained by us nor can be used as an excuse for refund or additional discount.
3. We have the authority to exclude candidates from our services for disciplinary offenses, inadequate attendance, or poor performance. This action is in accordance with the policies and procedures of our organization.
4. If a candidate is dissatisfied with the quality and delivery of the classes, they are encouraged to lodge a complaint with the management of Vyan Airways Services. We take such concerns seriously and will strive to rectify the problem promptly. Our aim is to ensure the satisfaction of our candidates and address any issues that may arise during the course of our services.
5. We maintain the right to modify and amend the terms and conditions of our services without prior notice. This includes the ability to make changes to the curriculum, course structure, and rules associated with our services. These modifications may occur for academic, regulatory, and operational purposes. Students will be subject to the latest regulations applicable to them during their participation in our services.
6. Candidates are responsible for promptly notifying us of any changes in their contact details, including permanent or temporary addresses, mobile numbers, and email IDs. This is necessary to ensure accurate and up-to-date records for our services and placement purposes.
7. As part of our services or for other purposes, we reserve the right to require the mandatory submission of education documents from candidates. This may be requested either before or at the time of placement, or even afterwards, as determined by our organization. The submission of these documents is necessary for the proper provision of our services.
8. Candidates are required to undertake and certify that the documents they submit to us are original, genuine, and not fake to the best of their knowledge. It is important to provide accurate and truthful information. If any document is found to be otherwise, penalties may be imposed, and separate legal action may be initiated by us in accordance with the relevant provisions of the law, before the appropriate court of jurisdiction.
9. Candidates are advised to stay informed about updates from us by regularly checking our notice boards and website. It is the responsibility of the candidates to stay updated with relevant information. We are not accountable for individual intimation of information to each candidate.
10. Our organization aims to provide consultancy services to enhance knowledge, professional development, and enrichment for candidates. We also offer job assistance to candidates who meet the eligibility criteria based on their strong basic qualifications. It’s important to note that while our services can provide additional weightage and support in job placement, they do not guarantee employment. Job assistance is provided based on the candidate’s qualifications and eligibility, but it should not be considered a job guarantee.
11. Understood. It is explicitly acknowledged and agreed that your organization shall retain all rights, title, and interest in any Intellectual Property Rights associated with teaching materials, lectures, practical lessons, and other related content developed or created by your organization. This agreement does not assign or transfer any rights, title, or interest in the Intellectual Property Rights of your organization or its affiliates to the other party.
12. All the material and contents provided by your organization pertaining to the Aviation industry are intended for consultancy services and best placement purposes only. Your organization and its team will not be held responsible for any misuse of the information, knowledge, tools, or any other content provided. It is the sole responsibility of the user to ensure proper and ethical use of the provided information and materials.
13. We acknowledge that we shall not be held liable for any failure to perform obligations under these terms and conditions if such failure is caused by events or acts beyond our reasonable control. These events may include acts of God, war, terrorism, industrial disputes (including disputes involving our employees), fire, flood, storm, and national emergencies. In the event of a Force Majeure Event, we will make reasonable efforts to minimize disruptions to our services.
14. The candidate agrees to indemnify, defend, and hold the organization harmless from any and all loss, damage, liability, and expense, including reasonable attorneys’ fees and costs, arising from any third-party claim, action, or proceeding directly or indirectly related to acts of omission or commission by the candidate or their agents. This includes breaches or alleged breaches, as well as failures to comply with applicable laws or regulations concerning the practice of the profession.
15. The liability of your organization towards the candidates is limited to the extent of the services provided to them. Your organization shall not be held liable to the candidates for punitive, exemplary, special, indirect, or consequential damages, including lost profits. The limitations on liability specified in these terms and conditions ensure that any potential liability is confined to the scope of the services offered and do not extend to punitive or indirect damages.
16. Each provision of these terms and conditions shall be considered separate and capable of being enforced independently. If any provision is deemed invalid or unenforceable, it will be removed from the terms and conditions. The remaining provisions will continue to be valid and in effect, and efforts will be made to amend them to the extent possible to reflect the intentions of the parties as originally intended, despite the absence of the severed provision.
17. In the event that any portion of these terms and conditions is deemed invalid or unenforceable according to applicable law, including warranty disclaimers and liability limitations, the invalid or unenforceable provision will be replaced by a valid and enforceable provision that closely aligns with the original intent. The remaining provisions of the terms and conditions will remain in effect and unaffected by the invalid or unenforceable provision.
18. You have the right to pursue legal proceedings in the case of any breach of trust or fraud committed against your organization. Legal action can be taken to address such offenses and seek appropriate remedies or recourse.

The failure to exercise or delay in exercising any right or remedy under these Terms and Conditions does not imply a waiver of that right or remedy or of any other rights or remedies under these terms and conditions or by law. Any waiver of a term or condition by your organization in a particular instance should not be interpreted as a waiver of that term or condition for the future or for any subsequent breaches. Each instance will be considered on a case-by-case basis, and the rights and remedies will remain in full force and effect unless expressly waived in writing.

This means that any legal proceedings or resolution related to such disputes will fall under the jurisdiction of these courts.
